Terms and Conditions
The customer
By placing an order on the website, the customer certifies that they are of the minimum age required to purchase any product in their order for which an age restriction is specified.
The Sales Contract
Once the Customer has completed their order, they will receive an email from Occicat Games acknowledging receipt of the order. This does not mean that the order has been accepted. The Customer’s order constitutes an offer made by the Customer to Occicat Games to purchase the Products. All orders are subject to acceptance by Occicat Games. Confirmation of this acceptance is provided to the Customer via a notification that the Products have been shipped (hereinafter referred to as the Shipping Confirmation). The contract between Occicat Games and the Customer (hereinafter referred to as the Contract) is formed upon the occurrence of one of the following events:
The shipping confirmation is sent,
Occicat Games receives payment for the order,
The Products are shipped to the Customer.
This Agreement applies only to Products whose shipment has been confirmed by Occicat Games in the Shipping Confirmation. Occicat Games is not obligated to provide any other Products included in the order until the shipment of such Products has been confirmed in a separate Shipping Confirmation.
Occicat Games reserves the right to:
to refuse all or part of an order if the Products are unavailable, for any reason;
to refuse all or part of an order if the Website contains obvious errors or inaccuracies regarding a Product’s description or price.
to impose restrictions on the quantities ordered of any Product, when the availability of such Products is limited.
Product Procurement
The Customer becomes the owner of the Products upon delivery.
Once the Products have been delivered, they become the Customer’s responsibility. Occicat Games shall not be held liable for their use, loss, or destruction.
Prices and Payment
The price of the Products is as listed on the Website, except as provided in the section on pricing errors below. The price of the Products is confirmed before the order is finalized, as well as in the Shipping Confirmation.
All prices are listed in the currency corresponding to the country selected by the Customer. The Customer will be billed in that currency.
Product prices are subject to change at any time. However, such changes will not affect orders that have been finalized and confirmed by a Shipping Confirmation.
Product prices may be subject to certain sales taxes depending on the destination to which the order is to be shipped. The prices listed on the Website at the time of confirmation include these taxes. If the Customer is responsible for paying a tax and Occicat Games has not collected it, it is the Customer’s responsibility to pay the tax if applicable.
Product prices do not include shipping costs, which will be added (if applicable) to the total amount due when the Customer confirms the order. Details regarding shipping costs are available on the Shipping and Delivery page of the Website.
It is always possible that, despite our best efforts, some of the prices of Products listed on the Website may be incorrect. If the actual price of a Product is lower than the price listed on the Website, Occicat Games will charge the Customer the lower of the two prices at the time of shipment. When the actual price of a Product is higher than the price listed on the Website, Occicat Games may, at its discretion, either contact the Customer to provide instructions prior to shipping the Products or cancel the order and notify the Customer of such cancellation.
Occicat Games is under no obligation to provide the Products to the Customer at an incorrect (lower) price, even after shipment confirmation, if the pricing error is obvious and unambiguous and could reasonably have been identified by the Customer as a pricing error.
Payment for the Products must be made using one of the payment methods available at the time of order confirmation.
Delivery
The Products will be delivered to the address specified by the Customer in their order and in accordance with the delivery option selected at the time of confirmation.
Occicat Games invites the Customer to check the "Order Shipping" section in the Shopping Cart.
Orders are shipped as soon as possible.
Occicat Games takes the necessary steps to ensure that orders are shipped and delivered within the specified timeframes; however, these timeframes are only estimates and are not binding.
Occicat Games may delay the shipping or delivery date, cancel a Contract, or remove Products from an order (without incurring any liability) if Occicat Games is delayed or prevented from carrying out its business due to circumstances beyond its control, including but not limited to: natural disasters, government actions, wars or national emergencies, terrorist acts, demonstrations, riots, insurrections, fires, explosions, extreme or unusual weather conditions, floods, epidemics, exceptional closures, strikes or other labor disputes, fuel shortages, restrictions or delays affecting carriers, or the inability to obtain, or delays in obtaining, adequate or suitable material supplies.
Occicat Games reserves the right to ship orders in multiple shipments if certain items are unavailable at the time the order is finalized, or if the order is too large to be delivered in a single shipment. In such cases, shipping costs will be charged to the Customer only once for the entire order. If the Website indicates that a Product is unavailable, the Customer is advised to place a separate order for the available Products to avoid any delays.
Cancellations and Returns
Occicat Games hopes that Customers will be satisfied with all Products purchased on the Website; however, they may cancel the Contract at any time, for any reason, within seven business days from the day they receive the Products (Cooling-Off Period). If the Customer decides to cancel the Contract, they will receive a full refund of the amount paid for the Products.
To cancel a Contract, the Customer must send a written notice, which Occicat Games must receive within the Cooling-Off Period, via email or regular mail. The notice must include the Customer’s name and address, as well as the order details. Email is the preferred method of communication. Occicat Games will be able to process the cancellation more quickly if the notice is sent via email. The Customer must also return the Product(s) to Occicat Games without delay, at their own expense and under their own responsibility, in the condition in which they received them. Occicat Games recommends using a registered shipping service to reduce the risk of the Products being lost.
When a Customer returns Products in accordance with the terms described, and provided that the Product is in the same condition as when the Customer received it, Occicat Games will refund the amount owed to the Customer as soon as the returned Product has been inspected, and no later than 30 days from the date of notification. Occicat Games will refund the full cost of the Products, including the initial shipping costs (but not the return shipping costs).
Products returned by the Customer due to defects will be examined by Occicat Games. If a defect is confirmed, Occicat Games will notify the Customer of their right (at the Customer’s discretion) to (i) an exchange of the Product, or (ii) a refund for the defective Product. If a refund is requested, Occicat Games will process the refund (including the initial shipping costs and the costs incurred in returning the Products) as soon as possible and, at the latest, within 30 days of confirming the right to a refund for the defective Product.
Occicat Games generally issues refunds in the form of a credit to the Customer’s account on the website. If the Customer requests an alternative method, Occicat Games will refund the amount using the same payment method the Customer originally used to make the purchase.
Except as provided by law, Occicat Games shall not be liable for any direct or indirect losses, damages, or expenses (including loss of profits, business, revenue, or intangible losses) resulting from or related to any defects in a Product, and shall not be required to pay the Customer any compensation other than the amount paid by the Customer to obtain the Product in question.
Nothing in these Terms is intended to limit the rights that the Customer may have as a consumer under applicable local law or any other statutory rights that cannot be waived, nor is it intended to exclude or limit Occicat Games’ liability in the event of the Customer’s death or personal injury resulting from Occicat Games’ negligence or fraud.
Customs duties
Your order may be subject to customs duties or taxes when the Product arrives at certain destinations. The Customer is responsible for paying such import duties and taxes. Occicat Games has no control over these charges and cannot predict their amount.
Complaints
Occicat Games is committed to providing high-quality service and pays close attention to the views, opinions, and feedback expressed by its customers regarding the products and services it provides. In the event that Occicat Games has not fulfilled its obligations to a satisfactory standard, customers are encouraged to contact Occicat Games, which will make every effort to resolve the issue.
General
Applicable laws require that certain information or communications be sent by Occicat Games to the Customer in writing. By using the website, the Customer agrees that communications between Occicat Games and the Customer will primarily be electronic. The Customer will be contacted via email or notified through notifications on the website. For the purposes of the Agreement, the Customer agrees to the use of these electronic means of communication and acknowledges that all Agreements, notifications, information, and other forms of communication provided to them electronically by Occicat Games meet all legal requirements for written communication.
Any notice from the Customer to Occicat Games must be in writing and sent by email, certified mail, or airmail. Our detailed contact information is available (see above). All notifications from Occicat Games to the Customer are posted on the Website, sent by email, or sent by registered mail or airmail to the address provided by the Customer to Occicat Games. Notifications posted on the Website will be deemed received immediately; those sent by email will be deemed received 24 hours after the email is sent; those sent by registered mail will be deemed received 3 business days after the letter is posted; and those sent by airmail will be deemed received 10 business days after the letter is posted.
This Agreement is binding on the Customer in his or her personal capacity. The Customer may not transfer or assign any of his or her rights or obligations under this Agreement, nor may he or she dispose of such rights in any other manner.
If any of these Terms or any provision of the Agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the validity of the remainder of the Agreement shall not be automatically affected. The remaining articles and provisions shall continue to apply in accordance with applicable law.
Occicat Games’ failure or delay in enforcing any or all provisions of this Agreement shall not be construed as a waiver by Alchemist Miniatures of its rights under the Agreement. Any waiver granted by Occicat Games in connection with a breach or violation by the Customer of any provision of this Agreement shall not be construed as a valid waiver for subsequent breaches or violations and shall in no way affect the other provisions of this Agreement.
Occicat Games reserves the right to occasionally revise and amend these Terms. The latest version of these Terms is available on the Website. The Customer is subject to the policies and Terms in effect at the time they order Products from Occicat Games.
No provision of any Contract shall apply to, or be relied upon by, any person who is not a party to the Contract.
